Legal basis for processing your personal data

We process data on a number of different legal grounds.

Contract with you

We process your personal data on the basis of a legally binding contract. This usually happens when you apply for a job at Askele. The processing of your personal data, such as your CV, application and references, is necessary to enable Askele to process job applicants' requests before a contract is concluded.

Your consent

Askele may process your personal data on the basis of your consent. You can withdraw your consent at any time.

Legitimate interest

Askele has a legitimate interest where we process your data for security, support and improvement purposes or where you are a customer contact/manager for our current and potential customers. Your personal data will be processed for business purposes in a way that does not conflict with your privacy rights or freedoms.

How your personal data is shared

Askele may share your personal information with third parties in the following circumstances:

Askele's forums

If you post a message, comment or do something similar on Askele's forums, such as YouTube or LinkedIn, this information can be read and used by anyone with access to such forums. Askele is not responsible for any information you post in such forums.

Partners

Askele may share your personal information with its partners where it is lawful to do so from a business perspective and in accordance with applicable data protection legislation.

Public authorities

Police and other authorities may request access to personal data from Askele. In these cases, Askele will only disclose the data if there is a court order, etc. to do so.

When do we use data processors?

Askele uses data processors to process personal data. These data processors are typically cloud or other IT service providers.

When using data processors, Askele enters into a data processing agreement to protect your privacy. If the data processors are located outside the EU/EEA, Askele will ensure the legal basis for such international transfers on your behalf using EU model clauses or an equivalent legal transfer mechanism.

How long your data will be kept

We will only store your personal data for as long as necessary to fulfil our contractual obligations. Where your personal data is processed for other lawful reasons, such as legitimate interests, it will be kept for as long as necessary to achieve the purpose of the processing.

Therefore, different retention policies may apply to personal data depending on the type and purpose of the data. Here are some examples:

For recruitment purposes, Askele will delete your personal data, such as your CV, application and other documents, once the recruitment process has ended, usually up to 6 months after the deadline for submitting your application, unless otherwise agreed with you.

Another example is contact information stored for marketing purposes, including leads or potential customers. Such personal data will be deleted no later than 24 months after the last registered activity.

What are your rights

You have the right to request an overview of the personal data we process about you and you may have the right to data portability. You also have the right to ask us to correct inaccuracies in your personal data.

In addition, you have the right to request the erasure of your personal data and to restrict or object to the processing of your personal data in accordance with this Privacy Policy or other service-specific terms and conditions.

Please send your data requests by email toprivacy@askele.fi. We will assess the right of the submitter of the request to review the data. If the request is legitimate, Askele will collect and deliver the data to the data subject.

You also have the right to lodge a complaint with a data protection authority about the processing of your personal data.

Marketing and profiling

Legitimate interest

When you interact with us, for example by visiting the Askelee website, downloading content or participating in webinars, we process your personal data on the basis of legitimate interest. One of the purposes of legitimate interest is the processing of data for direct marketing purposes.

Askele processes your personal data to provide you with relevant content through direct marketing on social media platforms, email or websites based on your preferences. The personal data processed is aggregated information about you, such as your IP address, interests (clicks, etc.), name and device. This is done using technologies such as cookies and is called profiling. Askele may also combine this information with other information we have about you based on our customer relationship with your company.

The purpose of profiling is to deliver customized marketing, to improve your experience on our services and website, and to provide services that match our customers' preferences. As a general rule, Askele's services are used as part of your work-related activities and your use of our services is not intended to reveal anything about your private life. Sensitive personal data will not be processed. Your personal data will therefore be processed from a business perspective in a way that we do not believe will compromise your rights and freedoms as an individual.

Askele uses email as a marketing communication tool based on your consent in cases where national marketing legislation requires consent for email marketing. If you have given your consent, you will always have the opportunity to opt-out as described below when you receive an email containing marketing.

You have the right to opt-out of receiving marketing communications and profiling, and you can do so in the following ways:

Please note that even if you opt-out of receiving marketing communications, you may still receive administrative messages from Askele, such as order confirmations and notifications, which are necessary to manage the services provided to Customers.

Askele as data controller

Askele acts as a data controller for various registers and personal data is processed in various systems. All systems used by Askele are security and data protection compliant and a separate data processing agreement is in place with each supplier to ensure that your privacy is protected and the commitments made to our customers are fulfilled. Personal data is also processed on systems operating outside the EU/EEA, but for the suppliers of these systems we have taken the necessary steps to ensure that the supplier is able to commit to an adequate level of security to safeguard personal data. For suppliers based in the US, we use EU standard contractual clauses in addition to the Data Processing Agreement.

Customer register

Askele processes personal data when providing its services to customers. Among other things, personal data is processed in connection with customer service, billing, sales services and the provision of services.

Personal data contained in the customer register

In order to provide the best possible service to our customers, we store in our systems the information necessary to manage the customer relationship and provide the service. This information includes:

  • The person's role in the company

Askele does not process sensitive personal data in its customer records.

We encourage you to check the statement regularly. If we make material changes to our statement that materially change our privacy practices, we may also notify you in other ways, such as by sending an email or posting a notice on our corporate website and/or social media pages before the changes take effect.
